Your Player Account You are allowed to have only one player account. if you attempt to open more than one player account, all betting accounts you try to open will be blocked or closed. if you notice that you have more than one player account under different names, you must notify the oerator immediately. the operator reserves the right to cancel any bets as well as winnings, block betting accounts, exclude the player from participating in other games and retain payments to the player. The Operator reserves the right to close Player Accounts, cancel transactions and retain the payment of funds if the player has made his account available to third parties, makes transactions on behalf of or in the name of third parties, in conjunction with third parties, in groups/syndicates of players by using front man, or by using impermissible software tools, or in violation of other provisions of these T&C. All telephone communications between you and the Operator may be recorded for security, training purposes and/or accounting purposes. All Internet communications between you and the Operator may be kept on record for accounting purposes. A Player Account is opened, held and settled in a currency as agreed between the Operator and you during registration. All amounts displayed relating to wagers and winnings shall be quoted with the symbol of the currency so agreed to. The Operator calculates and settles all matters involving exchange rates in accordance with recognised financial institutions at currently applicable exchange rates. Deposits into your Player Account You may participate in any Services only if you have sufficient funds in your Player Account. The Operator shall take all necessary measures in case of a use and/or abuse of a bug such as blocking of the Player Account, freezing of funds and eventually legal proceedings. Unless otherwise expressly advised the Operator’s Services are consumed instantly. Thus, the Operator cannot provide returns of goods, refunds or cancellation of the Service/s. If you use a Service or play a Game with real money, the money will be drawn from your Player Account instantly and there shall be no automatic cooling off period or right of withdrawal. top 6. Withdrawals from your Player Account The minimum withdrawal amount differs depending on the payment method used. More information can be found under withdrawal options. The Operator reserves the unlimited right to apply certain restrictions to the payout methods in designated countries and/or to certain players at its sole discretion. As a general rule, all funds that have been paid into the Player Account, shall be paid out in the same manner (credit card, bank transfer, wallets etc.) as the deposit occurred. The Operator has the exclusive and unfettered right to rule that withdrawals may be made only by bank transfer in order to validate the identity of the player. In the event of wins which amount to or exceed the sum of two thousand three hundred Euro (EUR 2,300) the Operator reserves the right to divide the withdrawal into several instalments paid in monthly equal instalments until the full amount is paid out. For transfers to accounts outside the European Union, the Operator may charge you with the transaction costs incurred. The Operator reserves the right to suspend or refuse a withdrawal in the event of actual or suspected fraud or money laundering. If the Operator mistakenly credits your Player Account with winnings that do not belong to you, whether due to a technical issue, error in the pay­tables, or human error or otherwise, the amount will remain property of the Operator and the amount will be deducted from the Player Account. If you have withdrawn funds that do not belong to you prior to the Operator becoming aware of the error, the mistakenly paid amount will (without prejudice to other remedies and actions that may be available at law) constitute a debt owed by you to the Operator. In the event of an incorrect crediting, you are obliged to notify the Operator immediately by email. top 7. Dormant (Inactive) Player Accounts If there is no recorded transaction activity on your Player Account for more than thirty (30) consecutive months the Player Account shall be deemed to be a dormant account under Malta’ s Remote Gaming Regulations (LN 176 of 2004 of the Laws of Malta as amended from time to time). For avoidance of doubt a dormant Player Account means a Player Account which has not recorded any log in or log out for a period exceeding thirty (30) consecutive months. In the event that your Player Account is deemed dormant in accordance with the preceding Clause the following shall apply: The Operator shall transfer the credit that may be on your Player Account to the bank account stated by you in your Player Account. In the event that you cannot be satisfactorily located or if the transaction to your bank account is unsuccessful, the remaining credit in your Player Account shall be remitted by the Operator to the Malta Gaming Authority. Once inactive funds have been transferred to the Malta Gaming Authority they cannot be claimed back. In such event you shall hold us harmless from any claims or losses for such credit. Your Player Account shall be blocked and may, at the Operator’s discretion, be closed. If your Player Account is deemed to be inactive, the Operator reserves the right to charge a monthly administrative fee of five Euro (EUR 5) or the equivalent in another currency (or the current balance of your Player Account, if less) as long as the balance of your Player Account remains positive. You authorize the Operator to debit this fee from your Player Account on the beginning of the month following the day on which your Player Account is deemed inactive, and on the beginning of every subsequent month that your Player Account remains inactive. The Operator will stop deducting the fee if the account balance is zero or if the account is re-activated. top 8. Complaints on Player Account Any claim regarding a transaction in conjunction with a Player Account shall be made to the Operator within six (6) months after the transaction, payment and/or settlement took place, or should have taken place; otherwise the Operator reserves the right, at its own discretion, not to consider the claim. top 9. Your obligations as a player You hereby declare and warrant that: You are over 18 years of age or such higher minimum legal age of majority as stipulated in the jurisdiction of your residence and, under the laws applicable to you, legally allowed to participate in the Services and Games offered by the Operator. All trademarks, service marks and trade names as well as images, graphics, text, concepts or methodologies (collectively the “Intellectual Assets”) found on the Platform, and the material contained therein are the exclusive property of the Operator and/or the Operator’s suppliers and partners. You are not entitled to exploit or otherwise use any Intellectual Asset for whatever purpose, except as is expressly permitted by law. Under no circumstances shall the use of the Platform grant to any user any interest in any intellectual property rights (for example copyright, know­how or trademarks) owned by the Operator or by any third party whatsoever. No rights whatsoever are granted to use or reproduce any trade names, trademarks or logos which appear on the Platform except as specifically permitted in accordance with the Terms of Use. It may be necessary to provide you with software (“ Software” ) supplied by third parties to enable you to use the products offered through the Services/Games. In such circumstances, you may be required to enter into a separate agreement with the owner in respect of your use of such Software (a “Third Party Software Agreement”). In case of any inconsistency between these T&C and any Third Party Software Agreement, the T&C will prevail in so far as the inconsistency relates to the relationship between you and the Operator. You will not use the Platform for any unlawful or fraudulent activity or prohibited transaction (including money laundering) under the laws of any jurisdiction. If the Operator has a suspicion that you may be engaging in or have engaged in fraudulent, unlawful or improper activity, including, without limitation, money laundering activities, or conduct otherwise in violation of these T&C’s, your access to the Website will be terminated immediately and/or your Player Account blocked. If your Player Account is terminated or blocked in such circumstances the Operator is under no obligation to refund to you any funds that may be in your Player Account and the Operator shall handle such funds as required by law. In addition the Operator shall be entitled to inform relevant authorities, other online service providers and banks, credit card companies, electronic payment providers or other financial institutions of your identity and of any suspected unlawful, fraudulent or improper activity and you will cooperate fully with the Operator to investigate any such activity. You may not, directly or indirectly, use the Operator’s Platform or Services to introduce viruses, Trojan horses, worms, logical bombes or other material that has a determent on the functionality of the website. BET ACCEPTANCE Definitions: For purposes of this Clause the following definitions shall apply: "Error" is a mistake, misprint, misinterpretation, mishearing, misreading, mistranslation, spelling mistake, technical hazard, registration error, transaction error, manifest error, force majeure and/or similar. "Influence Betting" is an act, prohibited by the Operator, where the holder of a Player Account, or parties acting in association such holder, directly or indirectly influences, or attempts to influence, the outcome of a match or an event. “Syndicate Betting" is an act, prohibited by the Operator, where the holder of a Player Account, or parties acting in association with such holder directly or indirectly evades, or attempts to evade, the Operator’s Rules. A bet placed on the Operator’s Platform is not valid until it is validated and shows in the customer bet history. Placing a bet through the Internet may be illegal in the jurisdiction in which you are resident and/or domiciled or in from which you are accessing the services; if so YOU ARE EXPRESSLY UNAUTHORISED to use a Card for the purpose of placing a bet. Unless accepted in Error, once accepted, a bet will remain valid and cannot be withdrawn. It is your responsibility to ensure details of the bets placed are correct. Should a dispute arise about the acceptance (or lack thereof) of any transaction in your Player Account, the transaction log database will be the ultimate authority in deciding such matters.
